Daldaroc Training Academy (DTA) | Master Terms & Conditions
These Terms and Conditions govern the relationship between Daldaroc Training Academy (DTA) and the Customer. By accepting a quote, providing written authorization, or making any payment, the Customer acknowledges having read, understood, and agreed to be bound by these Terms.
1. General Governance
- Binding Agreement: Payment (full or partial) constitutes a legally binding contract.
- Amendments: DTA reserves the right to amend these Terms and Conditions at any time without prior notice.
- Force Majeure: DTA shall not be liable for any failure or delay in performance arising from causes beyond its reasonable control, including but not limited to power failures (load shedding), strikes, pandemics, or natural disasters.
- Severability: If any part of this agreement is found unenforceable, it will be deemed separate and will not affect the validity of the remaining terms.
2. Quotes, Pricing, and Payment
- Quote Validity: Quotes are valid for five (5) days from issuance. Clearance items are valid for one (1) day only, subject to availability.
- Minimum Order Value: To qualify for listed website prices, orders must reach a minimum of R300.
- Payment Requirement: A 100% deposit is required upon order placement. No goods will be released, and no services will commence until full payment has cleared in DTA’s bank account.
- Pricing Variations: DTA strives for accuracy, but prices may vary based on supplier conditions. Always confirm final pricing with a representative.
3. Branded Goods and Promotional Products
- Customer Selection: The Customer is responsible for ensuring the suitability, size, and color of goods. DTA is not liable for inaccuracies in customer-selected specifications.
- Artwork Approval: * Customers receive two (2) free revisions; additional changes incur a fee of R350.00 (excl. VAT) per change.
- Binding Approval: Written or electronic approval of a proof is final. DTA is not liable for errors (spelling, grammar, color, or layout) identified after approval.
- Production Variance: Minor physical variations from digital proofs (color/texture) may occur due to material and ink differences.
- Intellectual Property: The Customer warrants they hold the rights to any logos provided and agrees to indemnify DTA against any third-party infringement claims.
- Storage: Goods not collected within 30 days incur storage fees. After 60 days, DTA reserves the right to dispose of goods to recover costs.
4. Training Programs (Online & In-Person)
- Enrollment: Non-transferable without prior written approval.
- Non-Refundable: All training program payments are strictly non-refundable.
- Conduct: Disruptive or disrespectful behavior may lead to removal from the program without a refund.
- Certification: Certificates are issued only upon meeting DTA’s attendance and assignment criteria.
5. Team Building Activities
- Liability Waiver: All participants must complete a waiver form. DTA holds no liability for injuries, accidents, or losses incurred during activities.
- Cancellation & Rescheduling: * A minimum of fifteen (15) days’ written notice is required for any cancellation or rescheduling request.
- Irrecoverable Costs: Regardless of when the cancellation notice is received (even if more than 15 days in advance), any costs already incurred by DTA—including but not limited to venue deposits, catering, materials, or prep-work—are strictly non-refundable.
- Refunds of the remaining balance are at the sole discretion of DTA.
- Equipment: The Customer is liable for any intentional damage to equipment or facilities.
6. Delivery, Returns, and Cancellations
- Delivery & Risk: Risk of loss passes to the Customer once items are handed to a third-party carrier. Delivery dates are estimates only.
- Order Cancellation (Goods): Branded/custom products cannot be canceled once production begins. A 100% handling fee applies to canceled orders with paid deposits.
- Defect Claims: Any claims regarding manufacturing defects must be submitted in writing with photographic evidence within 24 hours of delivery. DTA’s liability is limited to repair or replacement.
7. Limitation of Liability
- Maximum Liability: DTA’s maximum liability for any order shall not exceed the total price paid by the Customer for that specific order.
- No Consequential Loss: DTA shall not be liable for any indirect, incidental, or consequential damages, including lost profits or opportunities.
8. Marketing and Privacy
- Portfolio Usage: DTA reserves the right to use photos of branded products or event activities for marketing and social media purposes unless the Customer explicitly opts out in writing at the time of order.
